Illinois State Legislature Aims to Amend Food Handling Regulation Enforcement Act

The State Legislature of Illinois has introduced House Bill 3495 amending the Food Handling Regulation Enforcement Act. The amendment proposes the addition of Section 5 which would require restaurants to post food allergen information as specified by the U.S. Food and Drug Administration (FDA). In addition, the proposed amendment would:

  • Require restaurants to be aware of food allergy recalls from the FDA;
  • Require restaurants to indicate on a placard, poster, or menu that consumers with food allergies should inform a restaurant waiter or waitress of their allergy; and
  • Establish requirements for the placard, poster or menu information.
