France Issues Notice relating to the Ban on Packaging Made Entirely or Partly from Styrenic Polymers

France issued a notice relating to the application of article 23 of the Law No. 2021-1104 of August 22, 2021, on the fight against climate change and strengthening resilience, which contained a prohibition of packaging made in whole or in part of styrenic polymers or copolymers, non-recyclable and unable to integrate a recycling channel, as of January 1, 2025.

This new notice recognized a risk of contrariety with the future European Regulation on packaging and packaging waste and limits the application of the ban to packaging that does not fall within the A, B or C recyclability performance classes mentioned in Article 6 of the current draft of the European regulation.
Notably the European regulation referred to in the notice is still in draft and the corresponding requirements of the regulation might become applicable from 2028 or 2030.

EC Publishes Commission Delegated Regulation (EU) 2024/2555 amending Regulation (EU) 2019/1021 as regards hexabromocyclododecane

On September 27, the European Commission has published Commission Delegated Regulation (EU) 2024/2555 amending Regulation (EU) 2019/1021 as regards hexabromocyclododecane.

This Regulation amends Annex I to Regulation (EU) 2019/1021 on persistent organic pollutants. Specifically, this shall apply to concentrations of hexabromocyclododecane equal to or below 75 mg/kg (0,0075 % by weight) where it is present in substances, mixtures, articles or as constituents of the flame-retarded articles. For the use of recycled polystyrene in the production of EPS and XPS insulation material for use in buildings or civil engineering works, point (b) shall apply to concentrations of hexabromocyclododecane equal to or below 100 mg/kg (0,01 % by weight).

The exemptions laid down in this Regulation shall be reviewed and assessed by the Commission by January 1, 2026.

Japan Publishes Cabinet Decision on the Bill to Amend Consumer Product Safety Act Related to Toys and Children's Products

Japan’s Ministry of Economy, Trade and Industry published Cabinet Decision on the Bill for the Act for Partially Amending the Consumer Product Safety Act and Other Related Acts - Safety of Products for Children, e.g., Toys.

The revised Act aims to stipulate provisions in which: the manufacturers and importers of specified products for children (mainly products that are utilized primarily in children's everyday lives and require indication of the intended age range and precautions for use) are required to have the products meet the technical standards stipulated by the Government of Japan and indicate a warning about using the products, including the intended age range and precautions for use.

Health Canada Announces Proposal to Update National Standard for Tents

Health Canada has announced that the Canadian General Standards Board (CGSB) is proposing a minor update on the National Standard of Canada for tents.

The proposed updated version of CAN/CGSB-182.1, Flammability and Labelling Requirements for Tents, is available from the CGSB for a 60-day public review. Health Canada encourages all interested parties to review the standard and provide feedback directly to the CGSB by their closing date of November 16, 2024.

In 2023, Health Canada published a proposal to update the flammability and fire-safety labelling requirements in the Tents Regulations using an ambulatory reference to the CAN/CGSB-182.1-2020 standard. The proposal includes compliance periods that apply when the CGSB standard is updated.

EC Publishes Commission Delegated Regulation (EU) 2024/2564 amending Regulation (EC) No 1272/2008  as regards the harmonised classification and labelling of certain substances

On September 30, the European Commission has published Commission Delegated Regulation (EU) 2024/2564 amending Regulation (EC) No 1272/2008 of the European Parliament and of the Council as regards the harmonised classification and labelling of certain substances.

This Regulation amends Annex VI to Regulation (EC) No 1272/2008 by adding new substances to the list of harmonised and classified substances under the CLP regulation. 

It shall apply from May 1, 2026. However, substances and mixtures may be classified, labelled and packaged in accordance with Regulation (EC) No 1272/2008 as amended by this Regulation from October 20, 2024.

South Korea Drafts Special Bill on the Reduction and Management of Microplastics

South Korea has drafted a special bill on the reduction and management of microplastics. Through this initiative, the Korean government aims to protect public health and the environment from the harms of microplastics by enacting a law that establishes a comprehensive response system such as conducting a fact-finding survey on microplastics, regulating used emissions, and promoting mitigation and removal technologies.

The highlights of the bill include:

• Definition of microplastics
• Prohibition of the sale or manufacture of products that contain primary microplastics above safety standards 
• Prohibits the sale, manufacture, and import of plastic products or electrical and electronic products that may cause secondary microplastics

Canada: Québec Publishes Final Version of Chapter C-11 Charter of the French Language

The Quebec government published its final version of Chapter C-11 Charter of the French Language.

This aligns the new regulation with an existing legislation "Charger of the French language", modified by Bill 96 from 2022. It details circumstances in which trademarks may appear, particularly in advertising, as well as on products, public signs, and posters. Specifically, this clarifies the rules for displaying trademarks and other texts on public signs and in advertising, including the requirement for French to be “markedly predominant” on exterior signs.

Provisions specific to labeling of products comes into force on June 1, 2025, with an anticipated second set of regulations coming some time afterward.

   Implementation Date: July 1, 2025.
2. GB 17927-2024 Safety Technical Specifications for Flame Retardant Performance of Furniture
   This document specifies terms and definitions, requirements, test methods, inspection rules and identification of fire retardant for furniture.
   This document applies to upholstered furniture and furniture with soft wrapping.
   Publication Date: August 23, 2024
   Implementation Date: September 1, 2025.

EU: ECHA Issues Guidance Document on Complying with CLP when Making or Importing Candles

In August 2024, the European Chemicals Agency (ECHA) has issued a guidance document on Complying with Regulation (EC) No 1272/2008 on the classification, labelling and packaging of substances and mixtures (CLP Regulation) when making or importing candles.

UK Issues Product Safety Alert for Water Beads

On September 19, UK’s Office for Product Safety and Standards (OPSS)  issued a Product Safety Alert to warn of the risks that water beads can pose to children and vulnerable adults.

The Alert advises that water beads should be kept away from young children under 5 years of age, and only used with older children or vulnerable adults under close supervision.

Water beads (also known as superabsorbent polymers) are beads that can expand up to 400 times their original size when exposed to liquid, which means they can pose a serious risk of gastrointestinal blockage if ingested, or asphyxiation if inhaled into airways. They are marketed for various purposes, including for use as toys, in crafting, as home decor or in floristry. They are sold under a variety of names including, but not limited to, jelly balls, water balls, sensory beads or water crystals.

China publishes draft standard for children’s products

On August 27, the Standardization Administration of China has notified the World Trade Organization (WTO) on the draft standard for children’s products.

This draft standard specifies the general safety requirements for products (including trial products and free gifts) designed or intended for use by children under 14 years of age.

The draft is still in the early stages and possible changes to the text are expected. Once the draft is finalized and published, the standard is expected to have a 2-3-year timeframe for compliance.

On August 27, the Standardization Administration of China has notified the World Trade Organization (WTO) on the draft standard to revise GB 20400 - Safety technical specification for leather and fur products.

This draft document specifies the terms and definitions, product classifications, requirements, test methods and judgement for the safety of leather and fur products. This document applies to all types of leather and fur products as well as leather and fur parts of leather and fur products.

GB 18587 specifies the emission limits and test methods for hazardous substances from carpets, carpet underlays and adhesives, and specifies limits and test methods for hazardous substances in polyvinyl chloride flooring.

On June 28, 2024, the Australia Department of Climate Change, Energy, the Environment and Water (DCCEEW) updated the Industrial Chemicals Environmental Management (Register) Instrument 2022 adding five substances to its online registry. The five substances are:

•  β-Alanine,
•  Dechlorane Plus,
•  and UV-328.

On June 19, 2024, the Canada Environment and Climate Change Canada (ECCC) published Regulations Amending the Products Containing Mercury Regulations, SOR/2024-109, in Canada Gazette, Part II. The amending regulation aims to protect Canadians by reducing mercury-release risks, meeting Minamata Convention requirements, phasing out mercury-added products, aligning with international initiatives and clarifying regulatory provisions.

European Parliament and the Council of the European Union Publishes Amendment to Regulation on Mercury as Regards Dental Amalgam and Other Mercury-Added Products

On July 10, 2024, the European Parliament and the Council of the European Union published Regulation EU 2024/1849 amending the regulation on mercury as regards dental amalgam and other mercury-added products subject to export, import and manufacturing restrictions was published in the Official Journal of the European Union. The regulation aims to significantly reduce mercury emissions and environmental exposure by gradually phasing out mercury-added products and setting implementation timelines.

This regulation entered into force on July 30, 2024, and will be binding in its entirety and directly applicable in all Member States.

European Union EC Publishes Commission Notice on Application of Energy Labelling Requirements

On July 19, 2024, the European Commission (EC) published Commission Notice on the Application of Energy Labelling Requirements in the Light of the Court Order of 5 October 2023 in Case C-761/22.

The notice is about interpretation of Article 6, first paragraph, point (a), of Regulation (EU) 2017/1369 and the requirement to make reference to the energy efficiency class and range of the efficiency classes in the visual advertisements or technical promotional materials.

The EC will take adjustment time into consideration during infringement proceedings; obligations may not be enforced for up to six months (Jan. 19, 2025) following the notice in the Official Journal, and for up to 12 months in the case of previously printed materials.

On May 16, 2024, the Indonesia Ministry of Environment and Forestry published Regulation No. 7/2024 on Procedures for Issuing Recommendations on Import Approval of Ozone Depleting Substances and Hydrofluorocarbons. This regulation specifies comprehensive import procedures for ozone-depleting substances (ODS) and hydrofluorocarbons (HFCs). On June 13, 2024, the European Chemicals Agency announced that the Committees for Risk Assessment (RAC) and Socio-Economic Analysis (SEAC) had reached a preliminary conclusion on four industries that could be affected by the proposal to restrict per- and polyfluoroalkyl substances (PFAS) in the EU under REACH Regulation.

The conclusions agreed at RAC and SEAC meetings are provisional until the committees finish evaluating the whole restriction proposal (covering all sectors of usage) and approve their recommendations. These views will subsequently be shared with the public.

On July 10, 2024, the Ministry of Industry and Advanced Technology (MoIAT) recently made an important announcement regarding updates on ECAS/EQM LVE certification for universal type cord extension sets and socket-outlets.

According to the announcement, these products will no longer be required to undergo IECEE CBTR/CBTC testing. Instead, these products are required to have ISO/IEC 17025 accredited laboratory issued Test Reports issued only by Dubai Central Laboratory for its ECAS and EQM certification (UAE Certification).

Brazil INMETRO Proposes the Incorporation Into the National Legal System of the Draft Mercosur Technical Regulation for Gas Cooking Appliances

On July 12, 2024, the National Institute of Metrology, Quality and Technology (INMETRO) proposed the incorporation into the national legal system of the Mercosur Technical Regulation (RTM) for Gas Cooking Appliances (draft stage), replacing the Mercosur Technical Regulation Minimum Safety and Energy Efficiency Requirements for Household Appliances that Use Gas as Fuel, approved by GMC Resolution No. 36/08.

European Parliament and the Council of the European Union Publishes Ecodesign for Sustainable Product Regulation

On June 28, 2024, the European Parliament and the Council of the European Union published Regulation (EU) 2024/1781 establishing a framework for the setting of ecodesign requirements for sustainable products has been published on Official Journal of the European Union.

The new Ecodesign for Sustainable Product Regulation (ESPR) repeals the current Ecodesign Directive 2009/125/EC, which currently only covers energy-related products, to broaden its scope to all products placed on the EU market, whether produced inside or outside the EU.

ESPR sets a new sustainability and ecodesign approach enabling the adoption of product specific measure which will set, according to product category, new requirements including performance requirements, durability, carbon footprint, recycled content, and many more, with a strong focus on product information such as Digital Product Passport, labels and information requirements.

The new Regulation entered into force on July 18, 2024 and directly applicable in all Member States.

India TEC Further Extends Timelines for Mandatory Certification Date and Acceptance of Test Reports for Five Products for MTCTE

On July 1, 2024, the Telecommunications Centre (TEC) of India released notification F.No. 5-2/2024-TC/TEC - Extension of mandatory certification date for 05 products (ERs) notified under Phase-III, IV and V of MTCTE. Listed products notified under MTCTE Phase-III, IV and V is now extended until Oct. 1, 2024. While the last date for acceptance of test reports issued by labs accredited by International Laboratory Accreditation Cooperation (ILAC) signatories has also been extended to Sept. 30, 2024 for another five listed products. This notification basically amends the previous extension notification on April 1, 2024.

On June 28, 2024, the National Telecommunications Agency (ANATEL) of Brazil released Act No. 9960. This approves the technical requirements for assessing the conformity of the product type interactive screen for educational use and updates the Telecommunications Product Reference List.

This Act will be enforced on Dec. 25, 2024.

U.S. CPSC to Host eFiling Voluntary Stage Training Session

The U.S. Consumer Product Safety Commission will be hosting an eFiling Voluntary Stage Training Session on Wednesday, September 4th at 2pm ET.

This training session is designed for parties interested in eFiling and will cover eFiling basics, certification requirements, roles and responsibilities, and best practices.

eFiling is a CPSC initiative under which importers of regulated consumer products will electronically file (eFile) data elements from a certificate of compliance with U.S. Customs and Border Protection (CBP), via a Partner Government Agency (PGA) Message Set for products imported into the US under CPSC jurisdiction.

Canada Issues Notice with respect to certain per- and polyfluoroalkyl substances (PFAS)

On July 27, Canada’s Department of the Environment has issued Canada Gazette, Part I, Volume 158, Number 30: Supplement - Notice with respect to certain per- and polyfluoroalkyl substances (PFAS).

This notice requires relevant companies to provide this information on per- and polyfluoroalkyl substances (PFAS) listed in Schedule 1 of the notice (hereinafter referred to as “Schedule 1”) for the 2023 calendar year before January 29, 2025:

1. the name of the person;
2. the address;
3. the business number (Canada Revenue Agency)
4. the name, email and phone number of an individual authorized to act on behalf of the person; and
5. a declaration that the information is accurate and complete. The information shall be submitted to the Minister of the Environment using the online reporting system Environment and Climate Change Canada’s Single Window.

This document specifies the safety requirements of pushchairs when used for running/jogging or skating (excluding ice skating), intended for the transport of one or two children up to 15 or 22 kg each.

Pushchairs intended to transport the carer while pushing (e.g. the combination of longboard and stroller) are excluded from the scope of this document.

This document applies in conjunction with and in addition to the European standards EN 1888 1:2018+A1:2022 or EN 1888-2:2018+A1:2022 and it cannot be used separately.

This document specifies a method for determining the colour fastness to saliva of all kinds of leathers, independent of the colouring procedure applied.

The method uses an artificial saliva solution to simulate whether colouring materials can migrate from leather to the mouth or to the mucous membranes.

Utah Releases Notice of Exemption for Slippers – Filling Material Listing Requirements

Effective immediately from June 24, 2024, the Department of Agriculture and Food of Utah has announced that slippers containing filling material in the top portion are exempt from listing the filling material in the bottom portion. This notice is intended to streamline the compliance process and reduce the labeling burden on manufacturers, while still ensuring transparency and consumer safety.

Previously, regulations required that any filling material used in both the top and bottom portions of slippers be explicitly listed on the textile label.

All other labeling requirements remain unchanged. Manufacturers must ensure that the filling material in the top portion is accurately listed on the textile label.

Jamaica Enacts the Trade (Plastic Packaging Materials Prohibition) (Amendment) Order, 2024

On July 11, Jamaica has enacted The Trade (Plastic Packaging Materials Prohibition) (Amendment) Order, 2024.

This Order amends the principal Order the Trade (Plastic Packaging Materials Prohibition) Order, 2018, to update the definitions of ‘Single use plastics’ to include the following:

1. plastic food containers made wholly or in part of polyethylene, polypropylene or polylactic acid and prohibits their use, but does not apply until the 11th day of July 2024, to the importation of plastic food containers; until the 9th day of January 2025, to the distribution of plastic food containers;
2. cosmetic care or personal care products to which plastic microbeads or microplastics have been intentionally added.

This Jordanian standard specifies requirements for the content of chemicals in textile products in the field of safety, health and environment. Which are in direct or indirect contact with the human body, in addition to its accessories.

This Jordanian regulation shall apply on the following textile products: products containing at least 80 % by weight of textile fibres, furniture, umbrella and sunshade coverings containing at least 80 % by weight of textile components, and other textile components.

On August 1, 2024, the Council of Europe has published Metals and alloys used in food contact materials and articles - Second Edition of the EDQM technical guide.

Following the adoption of Council of Europe Resolution CM/Res(2020)9, this revised technical guide aims to ensure the safety and suitable quality of food contact materials and articles made from metals and alloys.

The guide includes modified safety data concerning specific release limits (SRLs) for chromium, manganese, thallium and a new section on zirconium and general recommendations for release testing.

Government of Canada issued Notice on PFAS Reporting Requirements

On July 27, 2024, a notice has been published in Canada Gazette, Part I, to request information on certain per- and polyfluoroalkyl substances (PFAS) on their own or in mixtures, products or manufactured items related to the calendar year 2023, with the intention to assess their actual or potential toxicity and to decide whether and/or how to control the risks posed by these substances.

Reporting requirements will apply to 312 PFAS included under Schedule I according to:

• Total quantity imported/manufactured of PFAS substances on their own and PFAS-containing mixtures, products or manufactured items;
• PFAS substances type, whether included in Schedule 1 Part 1, Part 2 or Part 3;
• Category or intended use of the manufactured item; and
• PFAS concentration in the manufactured item.

EC Publishes Regulation (EU) 2024/1781 on establishing a framework for the setting of ecodesign requirements for sustainable products

On June 28, the European Commission (EC) published Regulation (EU) 2024/1781 on establishing a framework for the setting of ecodesign requirements for sustainable products.

This Regulation establishes a framework for the setting of ecodesign requirements that products have to comply with to be placed on the market or put into service, with the aim of improving the environmental sustainability of products in order to make sustainable products the norm and to reduce the overall carbon footprint and environmental footprint of products over their life cycle, and of ensuring the free movement of sustainable products within the internal market.

This Regulation also establishes a digital product passport, provides for the setting of mandatory green public procurement requirements and creates a framework to prevent unsold consumer products from being destroyed. This Regulation applies to any physical goods that are placed on the market or put into service, including components and intermediate products, although it does not apply to: food, feed, medicinal products, veterinary medicinal products, living plants, animals and micro-organisms, products of human origin, products of plants and animals relating to their future reproduction and vehicles. The new regulation repealed the old Ecodesign Directive (Directive 2009/125/EC) on 18 July 2024.
