On Dec. 12, 2025, the European Commission (EC) repealed Directive 2009/48/EC and published Regulation (EU) 2025/2509 on the safety of toys.

This Regulation lays down rules on the safety of toys to achieve a high level of protection of the health and safety of children and other persons, taking due account of the precautionary principle, and it also establishes rules on the free movement of toys within the Union.

The new law will be a Regulation instead of a Directive without the need for any National transposition. It clarifies and introduces stronger requirements for economic operators with additional dedicated articles with obligations for fulfilment service providers and online marketplaces.

This Regulation was entered into force on Jan. 1, 2026, and becomes applicable from Aug. 1, 2030. Until then, products may be placed on the market under the existing Toy Safety Directive. However, Articles 28 to 44 and Articles 49 to 55 shall apply from Jan. 1, 2026.
