Regulatory authorities worldwide are increasingly targeting chemicals in articles, including the U.S. Environmental Protection Agency (EPA). The EPA regulates a growing list of chemicals under the Toxic Substances Control Act (TSCA) which exempted chemicals in articles. But recent regulatory updates now extend the TSCA’s impact to brand owners, wholesalers and retailers.

The following TSCA rules regulate chemicals in articles:

  • Certain Significant New Use Rules (SNURs)
  • Risk management rules for five persistent bioaccumulative and toxic (PBT) chemicals
  • The Mercury Inventory Reporting rule

A proposed reporting rule for per- and polyfluoroalkyl substances (PFAS) will also apply to chemicals in articles if it’s finalized as proposed.
