Food Contact Materials: MERCOSUR Publishes Resolution on Silicones Used in FCM

On Dec. 18, 2025, MERCOSUR published Technical Regulation on Silicones for the Manufacture of Materials, Packaging, Coatings and Equipment Intended to Come into Contact with Food (GMC Res. No. 34 / 2025).

This Regulation introduces a new positive list-based technical regulation specific to silicone materials intended for food contact, covering oils, resins, elastomers, additives, fillers and monomers.

This also modifies and excludes silicone-related provisions from previous GMC resolutions:

  1. Silicones removed from:
    • Part V of Annex to GMC Res. 02/12 (plastics)
    • GMC Res. 28/99 (elastomers), including:
      • Silicone elastomers
      • Additives used exclusively for silicone elastomers
      • Related notes
  2. Amendment to GMC Res. 27/99 (Adhesives):

    • New wording for point 2.1:
      • Adhesives may use substances from positive lists for:
        • Plastics
        • Plastic additives
        • Cellulosic materials
        • Elastomeric materials
        • Silicones

    All MERCOSUR member states must incorporate this resolution into their national laws by June 16, 2026.
