On December 18, 2024, the U.S. Environmental Protection Agency (EPA or Agency) published a final rule under Section 6 of the Toxic Substances Control Act (TSCA) to regulate the manufacture, import, processing, distribution in commerce, use, and disposal of Perchloroethylene (PCE), which is also known as Tetrachloroethylene. See our Regulatory Update for a summary of that rule, which is codified at 40 CFR Part 751, Subpart G.
On July 30, 2025, the EPA published a notice seeking public comment to inform its reconsideration of the regulation for PCE. The notice “invites public comment on all aspects of the PCE final rule, including but not limited to any existing or anticipated implementation issues associated with the final rule requirements, experiences with the PCE final rule since it went into effect, and whether the Agency should consider additional or alternative measures or approaches to address the unreasonable risk presented by PCE under the conditions of use.”
Comments must be received on or before August 29, 2025.
Recommended action items:
- review the final rule; and,
- consider submitting comments.
