On December 13, 2024, the U.S. Environmental Protection Agency (EPA) published a final Health and Safety Data Reporting Rule under Section 8(d) of the Toxic Substances Control Act (TSCA). This rule required certain manufacturers and importers to submit copies and lists of unpublished health and safety data studies. The original reporting deadline was March 13, 2025, for the 16 specified chemical substances. See our Regulatory Update for a brief summary of that rule, including the full list of the 16 substances.
On March 13, 2025, this deadline was extended June 11, 2025 for Vinyl chloride and to Sept. 9, 2025 for the other 15 chemical substances. See our Regulatory Update for more information on that rule.
On June 9, 2025, EPA further extended the reporting deadline for all 16 of the chemical substances subject to the rule to May 22, 2026. EPA took this action for a few reasons. The EPA needs additional time to provide finalized guidance on implementation problems that entities subject to the rule have raised. This guidance will address topics such as submitting harmonized templates. The EPA also believes that if all the chemical substances have the same reporting deadline, it will ensure consistency of the reporting requirements as well as provide the EPA with enough time to incorporate the data received for any of the EPA’s associated TSCA section 6 responsibilities. The effective date is on June 9, 2025.
