EPA Publishes List of TSCA CBI Claims Approaching Expiration

On April 24, 2026, the EPA announced the publication of a list that contains TSCA CBI claims that will expire between June 22, 2026 and July 31, 2026, and will be updated monthly.

Under Section 14(e) of the Toxic Substances Control Act (TSCA), new Confidential Business Information (CBI) claims have a 10-year "sunset" provision, meaning they will automatically expire unless the company reasserts and re-substantiates the claim with the Environmental Protection Agency (EPA). Thousands of CBI claims made in 2016, after the Lautenberg Act was signed into law, are set to expire in 2026.

The table, available from the link below, currently contains TSCA CBI claims that will expire between June 22, 2026 and July 31, 2026. It displays the CAS number, expiration date, and submission type for each of the expiring claims and contains 294 entries at this time.

In addition to updating the table monthly, EPA will notify the original submitter of each CBI claim directly through its electronic document system, the Central Data Exchange (CDX), at least 60 days prior to the expiration of the claim. EPA advises submitters to keep their contact information in CDX up to date to avoid missing these notices.

For companies with expiring claims that would like to extend their CBI protection period, a TSCA Section 14(e) CBI Claim Extension Request must be filed using the reporting application in EPA’s CDX. This request must be submitted no later than 30 days before the date the CBI claim is set to expire.
