Chemicals: New Mexico Signs Bill to Prohibit Products Containing PFAS

On April 8, 2025, the Governor of New Mexico signed HB 212 prohibiting certain PFAS substances in various consumer products. This act may be cited as the "Per- and Poly-Fluoroalkyl Substances (PFAS) Protection Act."

On April 8, 2025, the Governor of New Mexico, Michelle Lujan Grisham, signed HB 212 prohibiting certain PFAS substances in various consumer products. This act may be cited as the "Per- and Poly-Fluoroalkyl Substances (PFAS) Protection Act."

The regulation sets the schedule of the prohibition as follows:

  • January 1, 2027 - (1) Cookware, (2) food packaging, (3) dental floss, (4) juvenile products and (5) firefighting foam
  • January 1, 2028 - (1) Carpets or rugs, (2) cleaning products, (3) cosmetics, (4) fabric treatments, (5) feminine hygiene products, (6) textiles, (7) textile furnishings, (8) ski wax and (9) upholstered furniture
  • January 1, 2032 - All non-exempt products

It is also anticipated that the state’s Environmental Improvement Board will adopt rules that enumerate information required from manufacturers of products with intentionally added PFAS. Such manufacturers are required to submit the information before selling or distributing the products.
