Brazilian RoHS Officially Approved

Brazil published its RoHS regulation via CONAMA Resolution 516/2026, restricting 10 hazardous substances and creating a national EEE registry with documentation, traceability, and compliance deadlines.

The Brazilian National Council for the Environment (CONAMA) published Resolution No. 516, of July 8, 2026, establishing restrictions on the use of certain hazardous substances in electrical and electronic equipment (EEE).

Companies must register their electrical and electronic equipment, model, or product family in the National Registry of Electrical and Electronic Equipment Subject to Hazardous Substance Restrictions created by the Ministry of the Environment and Climate Change. The deadline for entering information into this Registry will be one year from the date the system becomes available.

Once registered, if the equipment meets the requirements specified in Chapter II of the Regulation, a self-declaration of conformity will be issued and made available to manufacturers and importers. This self-declaration of conformity must be included with the product packaging or accessible through an easy-to-access digital tool, while also being made publicly available on the Internet.

In addition to creating the National Registry, the Regulation also establishes maximum limits of 0.1% for Polybrominated biphenyls (PBB), Polybrominated diphenyl ethers (PBDE), Mercury, Hexavalent chromium, Lead, Di(2-ethylhexyl) phthalate, Benzyl butyl phthalate, Dibutyl phthalate, and Diisobutyl phthalate, and 0.01% for Cadmium (these are the same 10 hazardous substances as in the EU RoHS Directive).

The phased compliance deadlines are:

  • immediately for PBB and PBDE,
  • within 180 days for Mercury,
  • within three years for Cadmium, Hexavalent chromium, and Lead,
  • within four years for the Phthalates.

Exemptions include certain defense and security equipment, space equipment, fixed industrial equipment with large dimensions, some transport equipment, implantable medical electrical devices, certain photovoltaic modules, batteries, and equipment designed exclusively for research and development.

Manufacturers and importers must maintain Portuguese-language technical documentation supporting compliance with the hazardous substance restrictions, as well as the self-declaration of conformity, for a period of five years after product discontinuation.
