Taiwan Drafts New Management Measures on PFAS

Taiwan announced new controls on 269 PFAS which are regulated as concerned chemicals, to strengthen environmental and public health protection. The management will be implemented on Jan. 1, 2026.

In a major step toward aligning with international chemical safety standards, Taiwan’s Ministry of Environment (MOENV) announced a draft regulation to designate 269 Per- and Polyfluoroalkyl Substances (PFAS) as concerned chemical substances on Aug. 5, 2025. This move reflects Taiwan’s commitment to proactive environmental governance and public health protection.

Some PFAS, such as PFOS, PFOA, PFHxS, and their salts and related compounds have already been regulated under Taiwan’s Categories and Management of Handling for Toxic Chemical Substances due to their confirmed environmental and health hazards. Regarding the unregulated PFAS, due to the wide range of their applications, the MOENV plans to establish a new regulation on “List of Per- and Polyfluoroalkyl Substances and Management Measures” for the purpose of preventive management. Based on the different material forms and operational risks, the newly proposed regulation introduces a tiered management system for PFAS.

The 269 PFAS substances are categorized into three groups:

  • Perfluoroalkyl acids, their precursors, and other PFAS compounds (126 substances included in Attached Table 1),
  • PFAS polymers (113 substances included in Attached Table 2), and
  • PFAS gases (30 substances included in Attached Table 3)

A uniform control concentration threshold of 0.1% is applied across all groups of PFAS.

For Perfluoroalkyl acids, their precursors, and other PFAS compounds:

  • Activities such as manufacturing, importing, selling, using, and storing PFAS in concentrations >=0.1% require approval documents.
  • Operators must maintain monthly records and submit quarterly reports.
  • Containers and packaging must be clearly labelled and accompanied by safety data sheets (SDS).

For PFAS polymers and gases:

  • If concentrations are >=0.1% but <30%, only labelling requirements apply.
  • If PFAS are manufactured or imported in concentrations >=30%, the same full set of controls as the above PFAS compounds applies.

The regulation exempts PFAS used for experiment, research, education, and testing purposes from the control of concerned chemical substances. Additionally, a two-year grace period will be granted to affected operators following the official implementation to allow for compliance preparation.

The draft is undergoing public consultation for a period of 60 days and comments may be submitted by Oct. 4, 2025. The official regulation is planned to take effect on Jan. 1, 2026.
