With the publication of Directive (EU) 2018/725, the European Commission is lowering the migration limit for Chromium VI in scraped-off toy material (category III). Previously, Directive 2009/48/EC sets a limit for chromium VI for scraped-off toys, paints on toys, hard and soft polymers, wood, textiles, and more. The current limit value, 0,2 mg/kg, is based on a virtually safe dose of 0,0053 μg of chromium VI per kg bodyweight per day.

In 2015, at the request of the European Commission, the Scientific Committee on Health and Environmental Risks (SCHER) assessed the relevance of the oral cancer potency of chromium VI. After a lengthy investigation, the SCHER considered 0,0002 μg of chromium VI per kg bodyweight per day as an appropriate virtually safe dose. SCHER proposed 0,0094 mg/kg as a revised limit for chromium VI in scraped-off toy material in their release, “Chromium VI in Toys”.

However, compliance with the proposed limit cannot be verified with the European standard test method, EN 71–3:2013+A1:2014, since the proposed limit is almost six times lower than the lowest concentration (0,053 mg/kg) that can be reliably quantified with the test method.

Due to these circumstances, the subgroup ‘Chemicals’ of the Expert Group on Toys Safety established by the European Commission recommended to lower the limit for chromium VI from the current 0,2 mg/kg to 0,053 mg/kg.

The European Committee for Standardisation (CEN) is currently reviewing the test method in standard EN 71–3 to improve the detection limit of chromium VI. A revised test method is expected to be available soon, allowing for reliable measurement concentrations down to 0,0025 mg/kg. It would then be possible to strengthen the limit value for chromium VI in scraped-off toy material.

The new limit will go into effect on 18 November 2019.
