The European Commission (EC) has issued a Draft Regulation concerning a new restriction to be included in Annex XVII to Regulation (EC) No 19072006 of the European Parliament and of the Council concerning the Registration, Evaluation, Authorisation and Restriction of chemicals (REACH). This restriction will be in regards to certain substances classified as Carcinogenic, Mutagenic, or Toxic for Reproduction (CMR) in either Category 1A or 1B in:

  • Clothing or related accessories
  • Textiles other than clothing which, under normal or reasonably foreseeable conditions of use, come into contact with human skin to an extent similar to clothing (for example, bed linen, blankets, upholstery or reusable nappies)
  • Footwear

33 CMR substances are included in this DRAFT and can be grouped as:

  • Heavy metals (compounds of Cadmium, Chromium VI, Arsenic, Lead)
  • Chlorinated aromatic hydrocarbons
  • Phthalates
  • Polar aprotic solvents
  • Benzene and PAHs
  • Azodyes and Arylamines
  • Formaldehyde
  • Quinoline

Public consultation for this draft is opened until April 2nd, 2018. In review of the current DRAFT, the Regulation is expected to be published in the third quarter of 2018, after its publication in the Official Journal of the European Union and the new restriction will become applicable after 24 months.
