On December 22nd, 2015 the Legislative Decree (“Decreto Legislativo”) 4th December 2015, No.204 named “Disciplina sanzionatoria per la violazione del regolamento (CE) n.1223 ⁄ 2009 sui prodotti cosmetici.”
(Rules on penalties for violation of Regulation (EC) No 1223 ⁄ 2009 on cosmetic products) was published on the Italian Official Journal.
Please note that the Regulation (EC) No. 1223/2009, already in force, prescribes several obligations concerning both the Responsible Person (eg. Manufacturer, Importer) and the Distributor(s) of cosmetic products.

Among the novelties introduced by the Decree we’d like to point out the following:

  • The introduction of new sanctions, particularly in cases of violation of the obligations of Distributors according to the Regulation (for example concerning the verification of certain aspects of labeling, withdrawal/recall of a product from the market, communications to the competent authority and to the Responsible Person).
  • The adaptation of the previous national penalties for violations of obligations related to cosmetics.

Legislative Decree 204 ⁄ 2015 is already in force.
