THE ELECTRIC APPLIANCE SAFETY CONTROL ACT

Consumer goods being supplied to Hong Kong must comply with the general safety requirements or safety standards and specifications prescribed by the Secretary for Trade and Industry. These general requirements are set forth under the Consumer Goods Safety Ordinance.

Electrical Products Safety Regulation (EPSR) regulates all electrical products designed for HOUSEHOLD use in Hong Kong since its legislation in May, 1998 and requires that a Certificate of Safety Compliance be issued for imported products covered by the Regulation as a prescribed product. Persons affected by the EPSR may include manufacturers, importers, wholesalers, and retailers should such persons supply electrical products designed for household use in Hong Kong. The Electrical Mechanical Services Department (EMSD) of the Hong Kong Government oversees and is responsible in enforcing this regulation.

Currently Hong Kong does not mandate electromagnetic compatibility requirements for electrical products.

The EPSR serves to cover the safety requirements for all household electrical products to be sold and supplied in Hong Kong.

PRODUCT CLASSIFICATION

Products are classified into two categories, Prescribed Products and Non-Prescribed Products.

Prescribed Products:

Currently six products are classified as Prescribed Products:

  • Attachment plugs
  • Adaptors (having more than one socket for attachment plug)
  • Lamp holders
  • Flexible cords
  • Extension units
  • Unvented thermal storage-type electric water heaters

Non-Prescribed Products:

Covers all other household electrical products other than the aforementioned six Prescribed Products.

All products that fall under the EPSR must comply with the essential safety requirements of the Regulation for Non-Prescribed Products and shall additionally comply with the applicable specific safety requirements for Prescribed Products.

The essential safety requirements require a product to be:

  1. Properly marked, assembled, connected and insulated,
  2. Designed and constructed to prevent electrical and non-electrical danger,
  3. Designed and constructed to prevent danger arising from temperatures, arcs, radiation and hazardous materials,
  4. Designed and constructed to meet the expected mechanical requirements, to resist non-mechanical influences in expected environmental conditions and to cater for foreseeable conditions of overload, and
  5. Stable and able to be maintained in a specific position.

The easiest way to comply to the essential and specific safety requirements is by demonstrating compliance to those applicable IEC and/or British Standards (BS) as listed in the EPSR.

CHAPTER 106 TELECOMMUNICATIONS ORDINANCE

The provisions for the licensing and control of telecommunications services and telecommunications apparatus and equipment and radiocommunications equipment are covered under the Chapter 106 Telecommunications Ordinance. Under the Telecommunications Ordinance and its subsidiary legislation, all telecommunications equipment (TE) and radiocommunications equipment to be used in Hong Kong must comply with the prescribed technical specifications. Equipment that has been tested and found to be in compliance with the technical specifications will be granted a certificate by the Telecommunications Authority (TA).

Hong Kong Telecommunications Equipment Evaluation and Certification (HKTEC) is a scheme for the evaluation and certification of telecommunications equipment, including wireless (radiocommunications) equipment for use in Hong Kong and wire line equipment for connection to the public telecommunications networks (PTN). The HKTEC Scheme consists of the following components:

  • Classification of Certification Requirement
  • Recognized Testing Agency
  • Granting of Certificate
  • Labeling Requirements

Certification of TE is divided into two parts; a Voluntary Certification Scheme (VCS) and a Compulsory Certification Scheme (CCS). The Voluntary Certification Scheme applies to telecommunications equipment that is exempted from licensing and labeling under the Telecommunication (Telecommunications Apparatus) (Exemption from Licensing) Order, Cap. 106Z. It mainly consists of wire line equipment, such as telephones and fax terminals, and radiocommunications equipment, such as mobile phones and cordless telephones, that is acquired by customers for connection to the PTN and other general low power devices, including wireless microphones, remote controls and certain walkie-talkies. Telecommunications equipment subject to the Compulsory Certification Scheme (CCS) must be certified before it can be used in Hong Kong.

Labeling of TE is not mandatory. Equipment suppliers of TE certified under the VCS or CCS are authorized to voluntarily affix a label authorized by the TA. Although labeling is voluntary, the TA encourages suppliers to affix labels to certified equipment since it helps the consumers/general public identify compliance with the relevant technical specification.

For hybrid telecommunications equipment, i.e. equipment capable of being used in a combination of communications technologies, two separate certificate numbers will be issued to cover the radiocommunications and non-radiocommunications technologies. Separate labels are to be used to indicate compliance of hybrid equipment. However, as an option, the hybrid label may be used.

The scope of the HKTEC scheme includes telecommunications equipment (TE) including radio equipment for use in Hong Kong and wire line equipment for connection to the public telecommunication network (PTN).

All ancillary systems, such as voice mail servers, uninterruptible power supplies (UPS), chargers, digital phones, feature phones, alarms, etc. to be connected to the wire line equipment are not required to be tested and certified before the whole system can be connected to the PTN.

Exemptions

Section 39 of the Telecommunication (Telecommunications Apparatus) (Exemption from Licensing) Order, Cap. 106Z provides exemptions from licensing. The exempted apparatus include radiocommunication equipment for use in Hong Kong and wire line equipment for connection to the public fixed telecommunications networks. Radiocommunications apparatus to be exempted under the Order are required to meet the technical criteria set out in the schedules appended to the Order as well as any technical specification and certification requirements as may be prescribed by the Telecommunications Authority.

The following categories of radiocommunications apparatus are exempted from licensing:

  • 1.7 MHz / 47 MHz cordless telephone
  • 864.1 - 868.1 MHz cordless telephone
  • 46 MHz / 49 MHz cordless telephone
  • 254 MHz / 380 MHz cordless telephone
  • PHS (Personal Handy Phone System) equipment
  • DECT (Digital European Cordless Telecommunications) equipment
  • 2.4 GHz and 5 GHz radiocommunications apparatus employing frequency hopping or digital modulation (e.g. IEEE 802.11a, IEEE 802.11b and other wireless LAN products)
  • Low power device (e.g. Bluetooth products, remote controls, wireless microphones, walkie-talkies)
  • 27 MHz radiocommunications apparatus (e.g. model control equipment operating at 27 MHz)
  • 409 MHz short-range portable radio
  • Radiocommunications apparatus relating to taxi
  • Pager for public paging services
  • TDMA mobile telephone
  • CDMA mobile telephone
  • GSM/PCS mobile telephone
  • Mobile earth station
  • 3G mobile telephone
  • Radio Frequency Identification (RFID) equipment

Compliance with HKTA standards published by the Telecommunications Authority is required for the above product groups. Most Hong Kong standards (HKTA Nomenclature) are based on international standards with Hong Kong national differences
